1. Eligibility

You must be at least 18 years old and able to enter a binding contract to use the Services.

2. The Services

Diouf Media provides marketing strategy, paid advertising, AI follow-up systems, appointment setting, content, and related consulting for home service businesses. Specific scope, deliverables, fees, and timelines for engaged client work are set out in a separate written agreement or statement of work. These Terms govern your use of the public Site and forms.

3. Communications Consent

By submitting your information through any Diouf Media form, you expressly consent to be contacted by Diouf Media at the email address and phone number you provide, including for marketing, follow-up, and informational purposes via email, phone calls, and SMS/MMS text messages, which may be sent using automated technology. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies.

You can opt out of email at any time by clicking the "unsubscribe" link in any email, and you can opt out of SMS by replying STOP to any text message. Reply HELP for help.

4. Acceptable Use

You agree not to:

• Use the Services for any unlawful, harmful, or fraudulent purpose.
• Submit information that is false, misleading, or that belongs to someone else without their permission.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Site, our systems, or other users.
• Scrape, copy, or resell any part of the Site or Services without our written permission.

5. Intellectual Property

The Site and its content — including text, graphics, logos, images, code, and frameworks — are owned by Diouf Media or our licensors and protected by intellectual property laws. Marketing results vary based on market, offer, operations, and execution. We do not guarantee specific revenue, leads, appointments, or outcomes.

8. Limitation of Liability

To the maximum extent permitted by law, Diouf Media and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us in the 3 months preceding the claim or (b) $100 USD.

9. Indemnification

You agree to indemnify and hold harmless Diouf Media from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Exclusive jurisdiction and venue for any disputes lie in the state and federal courts located in Arlington County, Virginia, and you consent to that jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Updates become effective when posted on this page with a new "Effective" date. Your continued use of the Services after changes are posted means you accept the updated Terms.
